To recap, the hearing last October to appeal the development of the Des Moines Creek West Business Park-a proposed 403,000 square foot warehouse in an area comprised of 500 healthy trees and 4 wetlands and streams-was ruled in favor of Pannatoni Corporation, the developer. Jen-nay Russo, the appellant, has since filed a second appeal with the King County Superior Court. Jen was not informed of the date or the time of the second hearing on two separate occasions until the day before. On both dates, she took off work at the last minute, only to have the hearing postponed twice. Finally, on the third date, when the hearing was actually held-on Friday May 23, the city of Des Moines and Pannatoni argued that the case should be dismissed due to paperwork being filed improperly. Jen maintained that she was not given any instructions about the proper filing procedures, and was learning about the complicated process on the go without any legal help. The judge ultimately decided to delay the final hearing until Tuesday, June 10th. A gofundme campaign was created in a Hail Mary effort to obtain some funds for legal consultation to fight this development. This is a classic David and Goliath fight–the “little guy” valiantly working for environmental justice and equity against large corporations with deep pockets.
